General Conditions of Sale
VANNI S.r.l. Società Benefit is an Italian company, registered with the Turin Chamber of Commerce, with legal office in Turin, Via Giacinto Collegno, 46 / bis - 10138 Turin, VAT no. 05390870011. The sales contract stipulated between VANNI S.r.l. Società Benefit and the Customer ends with the acceptance of the order by VANNI S.r.l. Società Benefit.
This acceptance is considered tacit, unless communicated otherwise in any way to the Customer. By placing an order in the various ways provided by the site, the Customer declares to have read all the information provided during the purchase procedure, and to fully accept the general conditions transcribed below.
Through access to the site www.vanniocchiali.com, the Customer will conclude, following the indicated procedures, the contract for the purchase of the product. Once the purchase procedure is completed, the Customer will print or save an electronic copy and, in any case, keep these general conditions of sale, in compliance with the provisions of articles 3 and 4 of Legislative Decree 185/1999 on on-line sales.
It is forbidden for the Buyer to enter false and / or made up data in the registration procedure necessary to activate the purchase. The Customer releases VANNI S.r.l. Società Benefit from any liability arising from the issue of incorrect fiscal documents due to errors relating to incomplete or wrong data provision.
The glasses for sale on the website www.vanniocchiali.com are authentic. Before placing the order, the Buyer must familiarise with the essential characteristics of the glasses they wish to order on the website www.vanniocchiali.com .
Prices, descriptions or availability of the products displayed are subject to change without notice.
The prices indicated are those in effect when the purchase is requested and constitute an offer to the public according to art. 1336 of the Italian Civil Code, and include VAT and any other tax; in the case of delivery abroad, any additional costs due to taxes or fees provided for by the legislation in effect in the country of destination will be charged to the Customer.The sales prices do not include shipping costs that are invoiced in relation to weight, size and destination (on Italian or foreign territory) in addition to the price of the glasses purchased and indicated in the confirmation email. During specifically determined promotional periods, VANNI Srl Società Benefit may decide to fully cover the shipping costs.
The Customer can pay for the goods ordered using the payment methods indicated on the site. The amount of the order including shipping costs must be paid when confirming the order. As soon as payment is received, VANNI Srl Società Benefit processes the order and sends the goods within the times indicated.
Delivery and Shipping Methods
VANNI S.r.l. Società Benefit will deliver the products ordered through trusted couriers. Delivery times can vary from 2 to 7 working days from order confirmation, and will never exceed, in any case, those provided for in Legislative Decree 206/05 (30 days from order date). However, no responsibility can be attributed to VANNI S.r.l. Società Benefit for delayed or failed delivery due to force majeure or unforeseeable circumstances. The products will be delivered to the address indicated by the Customer at the time of the order. Products not collected by the Customer will be returned to Srl, which will refund the price of the products but not the shipping cost. VANNI S.r.l. Società Benefit cannot be held responsible for errors in delivery due to inaccuracies in the compilation of the purchase order by the Customer.
The sales invoice will be sent by e-mail to the Buyer upon delivery of the order.
VANNI S.r.l. Società Benefit is not responsible for any fraudulent and illegal use that may be made by third parties, credit cards or other means of payment.
Warranty, Assistance, Returns Procedure
VANNI S.r.l. Società Benefit markets products of verified quality, covered by a minimum guarantee of 24 months from the date of purchase, excluding interventions due to improper use of the object (damage from knocks, crushing or contact with chemical agents / perfumes, etc.). VANNI S.r.l. Società Benefit directly manages the warranty return.
The customer who for any reason is not satisfied with the purchase made, has the right to withdraw from the contract stipulated, without any penalty and without specifying the reason, within 10 days of receipt (DL 22/5/99, n. 185, art.5).
To make any return, the customer must follow the following instructions:
a) inform customer service;
b) send back the whole order (the box, the case and the glasses are included); c) return the package at Customer’s own expense.
Any risk related to the return of goods such as loss, degradation or theft is borne by the Customer. The withdrawal must be communicated by email to email@example.com (ph. +39 011 4474771), indicating the order number, within 10 days starting from the day following the date on which the products were delivered.
Once the withdrawal notice has been received, VANNI S.r.l. Società Benefit will communicate the instructions on how to return it to the Customer. Within 7 days, the Customer must ship the entire order subject to withdrawal.
VANNI S.r.l. Società Benefit will forward the full amount (excluding shipping costs) paid by the Customer within 30 days from the date of receipt of the returned goods, without prejudice to any restoration costs for damages ascertained to the goods. The right of withdrawal is however subject to the following conditions:
a) the law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased;
b) the purchased good must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment);
c) by law, the shipping costs for returning the goods are charged to the Customer; the delivery costs to the Customer and any other incidental costs highlighted at the time of placing the order will not be reimbursed; the shipment, until the certificate of receipt in our warehouse, is under the full responsibility of the Customer.
During specifically determined promotional periods,VANNI S.r.l. Società Benefit may decide to fully cover the shipping costs on the first return of the defective product or substitution of the product.
Damaged or Defective Products
The Buyer is required to examine the products at the time of their arrival to check for any defects or damage. In the event of evident damage, the Customer must send an email to firstname.lastname@example.org within 7 days of arrival or report the defect by telephone to +39 011 4474771. Even if the packaging is intact, the goods must be checked by VANNI S.r.l. Società Benefit. The customer can request the repair or replacement of the product subject to withdrawal.
VANNI S.r.l. Società Benefit reserves the right to charge the Customer for any costs incurred for the verification of the product and for the shipment of the product, if it is intact and functional or without the lack of conformity claimed and referable to the date of delivery, different to what is declared by the Customer.
Applicable Law and Jurisdiction
Any dispute relating to the application, execution, interpretation and violation of the purchase contracts stipulated via email with VANNI S.r.l. Società Benefit is subject to Italian jurisdiction; any dispute that may arise regarding the interpretation or execution of the these General Conditions of Sale will be left to the exclusive jurisdiction of the Court of Turin.
